Burlington Man and Woman Pull Gun on Man in Mount Vernon

Mount Vernon, WA – Mount Vernon Officers responded to a reported weapons offense at Draft Pics bar in  the 500 block of 1st Street in Mount Vernon around 10:21 p.m. on December 3rd, 2017.

According to a press release from Mount Vernon Police Department Lieutenant Greg Booth, Officers were advised that a subject had pulled a hand gun on another patron inside the business.   As Officers arrived, it was determined the suspects had already left the business and witnesses pointed them out to police as being a couple in a black Honda Car that was  parked on Myrtle Street.

According to Court documents obtained by SkagitBreaking.com through a public records request,  a Mount Vernon Officer  contacted the vehicle and held a man and woman at gunpoint until additional Officers could arrive.  Once additional Officers arrived, they attempted to take a man and woman into custody for investigation of the earlier weapon offense.  Both subjects, later identified as Benjamin “Benji” Emilio Rivera and Mandy Rivera of Burlington,  were uncooperative and not obeying officers commands. The female would not turn around, put down her purse  or get on the ground.  The female finally put her purse down and the male moved toward the female, telling Officers “it’s gonna be on if you hurt my girl.” Both subjects were taken into custody by multiple Officers restraining them.  The female continued to resist being  arrested and continued to pull away her arms and refused to be secured in the back of the police car. She had to be pulled into the vehicle and began kicking at Officers as they were attempting to close the door. The male refused to walk to the patrol car and had to be further restrained after he assaulted a Mount Vernon Officer by kicking him in the leg.  Officers then carried the man to the patrol vehicle before placing him into the back seat. The female continued to kick the patrol vehicle windows. Officers located a hand gun inside the woman’s purse.

Officers were able to interview witnesses and the victim of the incident and learned that the suspects had come into the bar and ordered a drink. They then sat down next to the victim.  The victim recognized the male from previously being in the bar and they were having a conversation before the conversation became heated and the suspect accused the victim  of being a cop. The suspect then grabbed a gun from the woman’s purse and pointed it at the victims abdomen area.  The suspect then told the victim “If you’re a cop, I’ll kill you right now” The suspect then made the victim say he wasn’t a cop while the gun was still pointed at him.  The suspect then stood up over the victim who was still sitting down. The suspect then made the victim get up and the three of them walked over to pay the bill.

A witness  noticed the victim appeared to be uneasy and scared and asked the group where they were going.  The victim did not answer and the suspect said “we’re going to his house” The witness  then asked if they all knew each other and the victim said “no.”  This is when the couple left the bar and Officers arrived shortly thereafter.

Benjamin “Benji” Emilio Rivera was booked into the Skagit County Community Justice Center on an INVESTIGATIVE HOLD for Assault 2nd, Unlawful Possession of a firearm, 1st degree kidnapping, harassment, and  assault 3rd. He is currently being held in LIEU of $100,000 bail. He has previous charges he is being held on for driving on suspended license, DUI, DUI and Violation of DUI restrictions.

Mandy Brook Rivera was booked into the Skagit County Community Justice Center on an INVESTIGATIVE HOLD for two counts of Assault 3rd, Resisting arrest, attempted escape 2nd, unlawful carry/conceal weapon, reckless endangerment, and assault 2nd.  She has additional charges of assault 3rd pending against her as well. She is being held in Lieu of $35,000 bail.
